It shall be unlawful for any person to operate any vessel on the water of this express: (a1) In a negligent manner as prescribed in divide 677017. Idaho Code while within one hundred (100) feet of another vessel; or (b2) At a go greater than no change state or five (5) miles per hour while within one hundred (100) feet of a dock swimmer or other person in the water except when safely pulling a water skier from a dock or when safely dropping off a water skier at or near a dock or when the swimmer or other person in the water is the vessel's wet skier. Except when dropping off a skier at or near a dock all efforts shall be made to reasonably decrease the time and hold the vessel shall travel inside the one hundred (100) pay zone while operating at speeds greater than no wake or five (5) miles per hour; or(3) While on a Personal Watercraft:(a) No person under the age of sixteen (16) years shall operate a personal watercraft except a person fourteen (14) or fifteen (15) years of age may operate a personal watercraft if the person has taken a six (6) hour boating safety course approved by the department and carries onboard proof of successful completion of said course.(b) No person shall direct a personal watercraft equipped by the manufacturer with a link-type engine cut-off change by reversal without attaching such link to the operator operator's clothing or the operator's personal floatation device as appropriate for the personal watercraft.(c) No passenger shall be permitted to ride in lie of the operator. Idaho has county-based marine law enforcement programs. That is enforcement on the water is not done at the express level but rather the county level. We have a group of county marine deputies called the Marine Advisory Council (MAC) that get together to discuss various items related to the state's boating program county marine law enforcement and state boating laws. Earlier this July a core group of MAC gathered and made recommendations to our agency for several revisions to the Idaho Safe Boating Act including the unanimous recommendation to seek an direct age limit for PWC operators. Marine Deputies from around the express have seen an increasing number of children and youths (some as young as eight-years-old) riding PWCs without adult supervision. As you experience PWCs are extremely powerful machines and inexperienced operators are not always familiar with PWC operation and existing boating laws. My personal belief is that this law will defend these young operators as well as other recreational boaters. We undergo a documented boating fatality in Eastern Idaho as recent as August 2006 where two youths (ages 13 and 15) were involved in a PWC crash and one of them was killed. In addition. Idaho is only one of two states (the other being Alaska) that do not have a minimum operator age for PWCs. The language being proposed for PWC regulation is supported by the Personal Watercraft Industry Association and is partially based on one of their model acts for PWC operation. As far as Ada County marine deputies. I can only assume they will enforce the law similar to the other 33 counties that act marine law enforcement. If you be more information. Our hope as IDPR is that if the law was passed county marine deputies would use the 2008 boating season as an opportunity to educate boaters on the new PWC law. I hope this answers your questions. I can't go to the meeting but I'd be in full support of this. In the last 5 years my wife and I have change state increasingly frustrated with PWCs (and this is one a relatively lightly used lake). PWC numbers seem to be on the go drivers seem to be getting younger and younger we're witnessing more and more close calls between boats and PWCs and common sense seems to be going by the wayside. While I'm not a big fan of gov't regulation this is one area where I'd accept it and wish that it's enforced.
Do you really feel a 14 kid shouldn't be able to control a jet ski even when you are there? If they get this threw that is a foot in the door for them. Next they will say a kid can't control the boat. Kids today are getting lazy and less involved in the outdoors this seems like a ameliorate way to alter it worse. Also maybe some of you should look that even an adult won't be able to have a kid ride in lie of them. So no taking your grandkids for a ride. I agree there needs to be super vision but I don't evaluate its alter to say they can't ride them. They can ride motorcycles and 4 wheelers snowmobiles etc why not a jet ski? There are a few flaws with it or things I don't like. For one they base the be on one accident. Tragic as it is it is another inspect of big brother saying since there was an accident we will place more hold back o n how you do things. And if on these why not others? Take more cram away from young people to do and learn and leave them with what to do?What about an age restriction on the age of a kid I can take on the river? Or if I want to teach a teenager to drive my ride? I do let kids drive my ride with supervision.
